If a family member, be it Mother, Father, Aunt, Uncle, or…a very close friend has deceased, you may find yourself in control of handling the sale of their estate.
It is a hard time dealing with the loss of someone special, family…or friend.
There could be numerous parties involved as executors/estate trustees, or one sole person. Understanding the steps of the process is important.
Once the Grime Team gives an accurate opinion of value on the property/properties, you can apply for probate through your lawyer, which starts the process through the court who has jurisdiction in the area of the estate sale.
Filing probate and how long it will take, we can never say. It comes down to the jurisdiction, the amount of probate filings through that court, and having all the necessary paperwork to your lawyer.
Can you Sell a property without probate being finalized?
Yes, you can.
With the proper clauses in place, and if a buyer agrees, a delay in closing in case probate has not been finalized is possible.
Some buyers will not like this uncertainty in the closing date, but in some circumstances, if you have an accepted offer on the property, the courts may “fast track” your probate application.
Our advice, is when dealing with an estate sale, contact a reputable lawyer (highly recomenned), have our team or an appraiser give an accurate opinion of market value, and have all necessary paperwork filled out in detail.
Once that’s done, it’s time to get the property ready for sale.
